It’s been over a year now since Massachusetts Law prohibited employers from asking Job Applicants about prior criminal convictions, but many business owners never received the message.  Business owners have a lot on their plate, and the list of rules and regulations is long and ever changing.  It’s nearly impossible for an employer to know every employment law.

This particular change in the law was clearly not communicated effectively to employers in Massachusetts.  We constantly meet with business owners who are using the same job application today that they were using 2 years ago.  These business owners are breaking the law and opening themselves up to a great deal of risk.  There is a simple fix; use an updated job application that does not ask this question.  As a best practice, business owners should be working to keep their employment policies and practices up to date.  The rules change every year, and if you don’t keep, you could find yourself in violation of the law.
